1. Data Protection and Security

The owners of these pages take the protection of your personal data very seriously. We treat your personally identifiable information as confidential, in conformity with the statutory data protection provisions and this data privacy policy.

The Controller, responsible for processing data on this website, as defined in General Data Protection Regulation (GDPR) and Bundesdatenschutzgesetzes (BDSG 2018), is OTC DAIHEN EUROPE GmbH, Krefelder Str. 675 - 677, 41066 Mönchengladbach, Germany.

In general, our website may be used without providing any personally identifiable information. If personally identifiable information is collected on our pages (for example, name, address or email addresses), this is always done on a voluntary basis to the extent possible. This information will not be disclosed to any third party without your express permission.

This site uses SSL encryption to ensure secure transmission of confidential data, such as requests, you send to us. You can recognize the encrypted connection, when the url-adress changes from “http://” to “https://” and the padlock symbol appears in the status bar of the browser window. If SSL encryption is activated, the data you transfer to us cannot be read by third parties.

We would like to point out that online data transfer (e.g. when communicating by e-mail) can have security loopholes. A seamless protection against access by third parties is not possible.

2. Server-Log-Files

The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

- Browser type, browser version
- Operating system used
- Referring URL
- Host name of the accessing computer (IP address)
- Time of the server query

The data processing is based on Art. 6 (1) (f) DSGVO for the purposes of our legitimate interests to ensure the stability and functionality of our website. The IP address may be further processed for the purpose of web analysis services (see also clause Web analysis service Matamoto), to verify your consent by obtaining the newsletter (see also clause Newsletter) or by visiting individual websites, into that Google Maps oder YouTube are embedded (see also clause Tools, Plugins and other). We reserve the right to subsequently inspect these data should specific evidence of unlawful use become apparent to us.

3. Data collection on our website

Contact form
When you send us requests using the contact form, your data, including the contact information you provide, will be used by us, based on Article 6 (1) (f) GDPR, to process your inquiry as well as any follow-up inquiries. If your request aims to enter into a contract the further processing is based on Article 6 (1) (b) GDPR. The data you provided by means of the contact form can be used to promote our products by letter post (see also clause promotion by letter post). We will not disclose this information without your permission to third parties.

Google Analytics

We use Google Analytics on our website. This is a web analytics service provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics uses cookies. Google Analytics can also use invisible graphics. This makes it possible to evaluate, for example, visitor traffic on our website. Information determined about the use of our website (including the user's IP address) is transmitted to a Google server, which may be located in the USA or other third countries, and stored there. Such data may be transferred by Google to Google's contractors.

When using Google Analytics, IP addresses are anonymised: Your IP address will be truncated by Google within member states of the European Union or in other states party to the Agreement on the European Economic Area. The full IP address is only transmitted to a Google server located in the USA in exceptional cases and truncated there.

For the use of Google Analytics, a contract for commissioned processing has been concluded with Google in accordance with Art. 28 GDPR. Google processes the data in order to evaluate your use of the website, to summarise website activities and to provide us with further services regarding the use of our website. Google may transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf.

In the event that personal data is processed by (sub-)processors in third countries that do not offer an adequate level of data protection, Google LLC, 1600 Amphitheatre Parkway, Mountain View, California 94043 USA, provides specific contractual conditions (i.e. standard data protection clauses, available at https://privacy.google.com/businesses/processorterms/mccs). The permissibility of the transfer is therefore based on the agreement of standard data protection clauses in accordance with Art. 46 para. 2 letter c of the GDPR in order to provide adequate safeguards with regard to the protection of the privacy and fundamental rights and freedoms of individuals for the transfer of the personal data concerned.

Purpose of the processing:

The integration of Google Analytics allows us to analyse user behaviour on our website and thus continuously improve our content.

Storage period, deletion and revocation options:

Personal data processed in this regard is only stored for as long as necessary for the purpose described or as required by law.

You have a right of withdrawal in relation to the processing of data using cookies: You can prevent the processing of your personal data by Google Analytics by clicking on the "Cookie settings" link in the footer area of the website and choosing the setting you want in the cookie banner that then opens. However, you may not be able to use our website or use it to its full extent if this data is not processed.

You are neither legally nor contractually obliged to provide your personal data within the scope of Google Analytics and this is also not required for the conclusion of a contract. However, if you do not provide this data, you may not be able to use our website or not be able to use it to its full extent.

4. Newsletter

If you subscribe to our email newsletter, we will send you regular information and offers regarding our products and services. The only mandatory information for sending the newsletter is your e-mail address. The indication of additional possible data is voluntary and is used to be able to address you personally.

To subscribe to our Newsletter, we use a “double opt-in” process. This means that we will not send you an e-mail newsletter, unless you have expressly confirmed to us that you agree to the sending of the newsletter. We will then send you a confirmation e-mail asking you to confirm that you wish to receive future newsletters by activating a link.

By activating the link you give us permission to use your personal data in accordance with article 6 (1) (a) GDPR. When you register for the newsletter, we store your IP address entered by the Internet Service Provider (ISP) as well as the date and time of registration so that we can trace any possible misuse of your e-mail address at a later time. The data collected by us when registering for the newsletter will be used exclusively for the purpose of advertising by means of the newsletter.

You may unsubscribe the newsletter at any time without incurring any costs other than the transmission costs in accordance with the basic tariffs. We do not charge any fees and expenses. Therefore every newsletter has a link to unsubscribe the newsletter. After activating the link your email address is removed from the distribution-list immediately.

5. Duration of the retention of personal data

We delete personal data, that is no longer needed for the purpose, to that it was collected and processed. Beyond that date we only store data to comply with regulations of the European Union or relevant regulations of a member state of the European Union.

We will delete personal data, we collected or processed based on your consent, if you withdraw your consent, unless the storage is necessary to comply with regulations of the European Union or relevant regulations of a member state of the European Union or is permitted by law otherwise.

6. Rights of the data subject

As person, subject to data procession, you have the right of access (Article 15 GDPR), right to rectification (Article 16 GDPR), right to erasure (Article 17 GDPR), right to restriction of processing (Article 18 GDPR) and right to data portability (Article 20 GDPR). You are also entitled to lodge a complaint with the relevant supervisory authority (Article 77 GDPR).

You have the right to object, on grounds relating to your particular situation, at any time to processing of personal data concerning you, which is based on point (e) or (f) of Article 6 (1) GDPR (processing of personal data in the public interest or based on legitimate interests). If you object we will no longer process the personal data unless we demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims.

Where we rely on your consent as the legal basis for processing your personal data, you may withdraw your consent at any time. A further processing of these informations on another legal basis remains possible, e.g. to meet legal obligations.
